Privacy Policy

This policy explains what personal data is processed when you visit this website or contact us through it, and what your rights are under the EU General Data Protection Regulation (GDPR) and the French Data Protection Act.

In short: we only collect what you type into the contact form, we use it to answer you, and we measure visits with Google Analytics and Çizeylem, which set cookies only if you accept them.

Who is responsible

The data controller is Irène Mejia, entrepreneur individuel (EI) (trading as TDC Artists), 25 avenue Corentin Cariou, Bâtiment C, 75019 Paris, France.

For any question about your data, or to exercise your rights, write to business@tdcartists.com.

The contact form

What we collect. Your name, your email address and, if you choose to give them, your organisation, the artist you are writing about, a subject and your message. You decide what goes into the message; please do not include sensitive information.

Why. To answer your enquiry and, where it leads to one, to prepare and follow up an engagement with an artist we represent.

Legal basis. Taking steps at your request before a possible contract (Article 6(1)(b) GDPR) and our legitimate interest in answering the professional enquiries we receive (Article 6(1)(f) GDPR). The checkbox on the form confirms that you have read this policy; it is not a request for consent to marketing. We do not send newsletters or marketing emails.

How long we keep it. Your message reaches us as an email. We keep it for as long as needed to handle your enquiry and the professional relationship that may follow, and for no more than 3 years after our last exchange, unless a longer period is required by law (for example, accounting records for a signed contract).

Who receives it. The TDC Artists team only. We do not sell or share your data. Two service providers process it on our behalf:

  • Hostinger International Ltd (Cyprus, EU) hosts the website and runs the code that receives the form, on servers in PLACEHOLDER: data centre country.
  • Resend (Plus Five Five, Inc., USA) delivers the form to our mailbox. Emails are sent from Resend’s European region (Ireland); Resend keeps a copy of each message and its delivery logs for a limited period under its own retention settings.

Resend is based in the United States and is certified under the EU-U.S. Data Privacy Framework, which the European Commission recognises as providing an adequate level of protection (Article 45 GDPR). Its data processing agreement also includes the European Commission’s Standard Contractual Clauses.

Our mailbox is provided by Google (Google Workspace), under its data processing terms.

Spam protection (Cloudflare Turnstile)

To keep automated spam out, the contact form uses Cloudflare Turnstile. It is loaded only on the contact page. To tell people from bots, Cloudflare processes technical information from your browser and device, such as your IP address and browser characteristics. Cloudflare states that this information is used solely to detect and block bots, not to identify, profile or target anyone. The legal basis is our legitimate interest in protecting the form from abuse (Article 6(1)(f) GDPR). Cloudflare, Inc. is based in the United States and is certified under the EU-U.S. Data Privacy Framework (Article 45 GDPR). See Cloudflare’s Turnstile Privacy Addendum.

Visiting the website

Hosting. When you load a page, our hosting provider Hostinger necessarily processes your IP address and technical request data to deliver the page and protect the site against attacks. These logs are kept for a short period and are not used to identify you.

Audience measurement without cookies. We count visits with Cloudflare Web Analytics. It uses no cookies, does not store anything on your device and does not follow you across websites. It gives us anonymous, aggregated figures only (for example, how many people visited an artist’s page). The small counting script is served by Cloudflare, Inc. (see above). Because it stores nothing on your device, it does not require your consent.

Fonts. All fonts are served from our own website; no request is made to font services such as Google Fonts.

Cookies

We measure how the website is used with Google Analytics and Çizeylem: which artist pages are visited, whether videos are played, whether press kit files are downloaded, and how many enquiries are sent from the contact form. We see this as statistics. We do not use these tools for advertising, we do not link them to your identity, and we never send them what you type into the contact form.

Without your consent (before you answer the banner, or after “Refuse”), both tools still receive these page and click events, together with your IP address and technical browser information, but no cookie is set and nothing identifying you is stored on your device: Google Analytics runs in its cookieless mode, and Çizeylem keeps its visitor identifier in memory only, so each page you open counts as a new anonymous visit. The legal basis is our legitimate interest in knowing how our website is used (Article 6(1)(f) GDPR).

With your consent (“Accept”), the cookies listed below are also set, so that a returning visitor is recognised and a visit across several pages is counted as one. The legal basis is your consent (Article 6(1)(a) GDPR and Article 82 of the French Data Protection Act). You can change your choice at any time with “Cookie settings” at the bottom of every page; refusing after accepting removes these cookies. We ask again after 6 months.

Google Analytics (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Cookies: _ga and _ga_<id>, kept for 13 months at most. Google processes your IP address to deliver the service; Google Analytics does not store it. Advertising features and Google signals are turned off. Data may be transferred to Google LLC in the United States, which is certified under the EU-U.S. Data Privacy Framework (Article 45 GDPR). Analytics data is kept for up to 14 months. See Google’s Privacy Policy.

Çizeylem (PLACEHOLDER: company name and address of the Çizeylem operator; PLACEHOLDER: country where Çizeylem data is stored). Cookie: cz_id, a random visitor and session identifier kept for 12 months at most.

Other storage. Your choice itself is kept in your browser’s local storage (tdc-consent), so that we don’t ask on every page.

Videos (YouTube)

Artist pages show YouTube videos as a still image with a play button. The image is served from our own website, and nothing is loaded from YouTube until you click play. When you do, the video is loaded from YouTube (Google), which may then set cookies or similar trackers and process your IP address under Google’s Privacy Policy. If you prefer not to, simply don’t press play; you can also watch the video directly on YouTube.

Your rights

You have the right to access your data, to have it corrected or erased, to restrict or object to its processing, and to receive it in a portable format. You can also give instructions about what happens to your data after your death.

To exercise any of these rights, write to business@tdcartists.com. We will answer within one month.

If you believe your data is not being handled properly, you can lodge a complaint with the French data protection authority, the CNIL: 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France (www.cnil.fr).

Changes

We may update this policy when the website or the services we use change. The date below shows the latest version.
